Veitch files additional appeal of firing

Former Kentucky Chief State Steward John Veitch recently filed a supplemental appeal of his firing last year that alleges Public Protection Cabinet Secretary Robert D. Vance did not have the authority to dismiss him, according to published reports.

In December, Vance said he made the decision to fire Veitch.

"My dismissal was not only improper, but violated my statutory and constitutional rights because Vance had no authority to dismiss me as chief state steward," Veitch, who was dismissed from his position on November 28, said in the supplemental appeal filed by his attorney, Tom Miller.

“Because only the Kentucky Horse Racing Commission had the authority to dismiss me, Vance's unilateral decision was a clear statutory and constitutional violation of my rights and not effective. Therefore, I remain employed by the Kentucky Horse Racing Commission."

At the time of Veitch’s dismissal, the Public Protection Cabinet said that because his firing was being taken “without cause,” which meant he did not have the right to appeal the dismissal. But an appeal form submitted on November 30 by the 66-year-old Racing Hall of Fame trainer cited several reasons why he should be allowed to appeal the firing, including a claim of age discrimination.

In early 2011, Veitch was cited by the Kentucky Horse Racing Commission for his handling of the 2010 Breeders’ Cup Ladies’ Classic (G1) in which Life At Ten was not competitive and was eased. Her poor performance followed a television interview in which her jockey, John Velazquez, raised concerns about how the dual Grade 1 winner was warming up.

Kentucky Hearing Officer Bob Layton determined in December that Veitch failed in his duties at chief state steward before and after the Ladies’ Classic. Layton said Veitch failed in his responsibilities when he allowed Life At Ten to start, despite having knowledge that Velazquez had raised concerns about her health during a prerace interview with ESPN. The hearing officer also determined that Veitch violated KHRC rules when he failed to request a post-race test for Life At Ten.

Miller said that other KHRC staff members failed to take action and believes veterinarians and the two other stewards could have taken action.

Veitch has asked to be reinstated and awarded damages.
