Magna committee to take deposition

The Official Committee of Unsecured Creditors will take deposition on key issues in the Magna Entertainment Corp. bankruptcy case on June 3 and 4.

The deposition could provide additional information about the reasons for the racetrack owner’s financial troubles. The United States Bankruptcy Court for the District of Delaware has called on Magna representatives to provide information at the two-day deposition.

Issues to be examined include transactions made by Magna since 2004, all proposed and actual sales of any key Magna assets or assets of Magna Chairman Frank Stronach since ‘04, and Magna’s ‘04 consideration of privatizing and why the company never pursued that that option.

The committee also will look at Magna’s efforts to sell properties and improve operating results between 2004 and ’08 as well as examine the relationship and reason for departure of several key Magna executives. In all, the court lists 13 topics to be covered on June 3 and nine on June 4.
