Greenlight Capital to oppose Magna’s financing plan

Bankrupt racetrack owner Magna Entertainment Corp.’s plan to continue day-to-day operations will face at least one significant hurdle.

Greenlight Capital Inc., a minority shareholder with Magna’s parent company, MI Developments Inc., filed a motion on Thursday noting its intent to oppose a plan for the parent company to grant a $62.5-million financing facility to Magna Entertainment.

In court documents filed with the United States Bankruptcy Court for the District of Delaware, Greenlight Capital said MI Developments failed to inform the court that Greenlight objected to the debtor-in-possession (DIP) plan to pay for Magna’s day-to-day operations.

“Greenlight agrees with debtors that the remaining issues regarding the revised interim DIP financing order should be heard promptly,” said the notice of intention filed Thursday with the court overseeing Magna’s Chapter 11 bankruptcy.

A New York-based hedge fund founded by David Einhorn, Greenlight Capital is asking that its concerns be heard during a Friday hearing that will examine the DIP financing agreement. The court revised the original filing by MI Developments to note that based on an Ontario Securities Commission regulation, minority shareholders do have protection on these types of financing issues (to view related story, click here).

In 2005, Greenlight unsuccessfully pushed for MI Developments to cut ties with Magna Entertainment.
