N.J. governor backs legalized sports gambling

In their efforts to bring sports gambling to state racetracks, New Jersey horsemen have picked up a powerful ally in Governor Jon Corzine.

Corzine has joined Garden State horsemen’s groups in a federal lawsuit filed March 23 in Trenton, New Jersey, that aims to overturn a federal law that prohibits most states from offering sports gambling. In joining the lawsuit, Corzine cited the addition of sports gambling and table games at Delaware racetracks as a threat to New Jersey tracks and casinos.

“Delaware’s entry into sports wagering and table games is a serious threat to both the casino and horse racing industries in New Jersey,” Corzine said. “We must do everything in our power to stay competitive. We simply cannot afford to sit back and let neighboring states press an unfair advantage against us anytime, and certainly not in the midst of this global economic crisis.”

Delaware is one of four states not included in the federal law, along with Nevada, Oregon, and Montana.

In March, New Jersey State Senator Raymond Lesniak and the Interactive Media Entertainment and Gaming Association, a pro-gambling group; were joined by the New Jersey Thoroughbred Horsemen’s Association, Thoroughbred Breeders Association of New Jersey, and the Standardbred Breeders and Owners Association of New Jersey in the suit that argues the Professional and Amateur Sports Protection Act of 1992 is unconstitutional.

The suit contends the federal law violates commerce laws in general and specifically violates equal protection clauses by granting sports gambling to the four states. The suit claims the law violates several other clauses.

In May, a Delaware law paved the way for that state’s racetracks to add sports gambling. In announcing his plans to join the lawsuit, Corzine cited estimates that sports gambling could generate $10-billion in handle annually in New Jersey and $100-million in tax revenue.

“The federal government’s prohibition on sports betting for some but not all states is fundamentally unfair,” Corzine said. “There should be uniformity in the application of federal law. If one state is allowed to legalize betting on sports events, all states should be allowed the same opportunity.”
