Fairmount Park to end meet early

Fairmount Park has received permission from the Illinois Racing Board to end its meeting on August 15 instead of September 26 as originally scheduled.

The Collinsville, Illinois, track, which began its meeting on April 7, has been conducting live racing on Tuesday afternoons and Friday and Saturday nights.

Fairmount’s management had been hoping that a windfall of impact fee surcharge revenue from the state’s four largest riverboat casinos would wipe out overpayments in the purse account but the casinos have blocked the payments by filing two lawsuits aimed at preventing tracks and horsemen from receiving money being held in escrow.

The lawsuits were filed in June after the U.S. Supreme Court announced it was not going to hear the four casinos’ appeal of an Illinois Supreme Court ruling that upheld the legality of 2005 legislation that called for them to pay a surcharge of 3% of their adjusted gross revenue to the state’s tracks and horsemen.

Nearly $80-million in impact fee surcharge money from the 2005 legislation is being held in escrow as is more than $9-million from the 2008 extension. The extension was signed by former Governor Rod Blagojevich on December 15, shortly after his arrest by the FBI on an assortment of criminal charges, among them allegedly demanding campaign contributions in return for signing legislation and filling the U.S. Senate seat vacated by President Barack Obama.

The June lawsuits contend that the signing of the impact fee surcharge legislation was part of “a scheme to obtain campaign contributions in exchange for official actions.”

Meanwhile, at its July 14 meeting the Illinois Racing Board followed up on the U.S. Supreme Court decision by certifying the distribution of the impact fee money in escrow.

“The funds are still not available for distribution because there are pending legal matters,” said Marc Laino, the board’s executive director. “In the event, the moneys are released we want to be in a position to distribute them.”

By a 9-1 vote the board adopted the recommendation of its staff—reinforced by a legal memorandum on the interpretation of the statute—and decided to use the money for future purses rather than make retroactive payments.

While the money remains in legal limbo, stiff new competition for Illinois racetracks emerged on July 13 when Gov. Pat Quinn signed a bill that will allow restaurants and bars to have up to five video poker machines. It is estimated that eventually there may be 45,000 machines in the state but tracks and off-track betting parlors are excluded from the program that is expected to generate $300-million yearly in tax revenue.
