Montana governor vetoes parts of horse slaughter bill

Montana Governor Brian Schweitzer partially vetoed a bill on Friday that would allow the construction of a plant to slaughter horses for human consumption.

House Bill 418, introduced by state Representative Ed Butcher (R-Winifred), would have allowed the construction of a horse-slaughter facility and offered it legal protection from anyone challenging the legality of the plant.

In a letter to Speaker of the House Bob Bergren (D-Hill County) and Senate President Robert Story Jr. (R-Stillwater), Gov. Schweitzer wrote that he is returning the bill with amendments that remove the special legal protection that would have been given to the owners of the facility.

In its current form, HB 418 states that anyone wishing to contest the construction of a plant must post a bond equal to 20% of the estimated construction costs. It also prohibits a court from issuing an injunction based on a challenge brought from the public.

“In other words, I believe that the legal standards currently in existence sufficiently safeguard the rights of all parties, and, conversely, that the restriction upon a court’s power to enjoin construction of a facility unnecessarily tips this balance,” Gov. Schweitzer wrote.

Gov. Schweitzer wrote in his letter that his amendments do not prevent the licensing and operation of a horse slaughter facility in the state.

Butcher told the Billings Gazette he plans to reject the governor’s amendments. The bill will return to the governor's office in its original form if a majority of the legislature rejects Gov. Schweitzer’s amendments.
