Blagojevich signs casino impact fee legislation

Illinois Governor Rod Blagojevich signed legislation on Monday that requires four casinos in the state to pay a percentage of their adjusted gross revenue to the state’s tracks and horsemen.

The bill is an extension of legislation passed and signed by the governor in 2005 and calls for two Northern Illinois casinos in Joliet, one in Elgin, and one in Aurora—the four highest earning casinos in the state—to pay the surcharge. Terms call for 60% of that amount to go to purses and the remaining 40% to be used by Thoroughbred and Standardbred tracks for marketing and improvements.

Blagojevich recently was arrested and charged with an assortment of political corruption charges, the most serious being his alleged attempt to auction the United States Senate seat vacated by President-elect Barack Obama.

Blagojevich, who was arrested on December 9, remains in office, saying he is innocent and has no plans to resign. An Illinois House committee was scheduled to meet on Wednesday to discuss potential impeachment proceedings.

The legislation would extend for another three years a law that previously existed for two years but expired in May 2008. Legislators created the law to compensate horse racing for business that was siphoned away by the casino industry.

Complicating the matter, the original 2005 impact fee legislation has been caught up in court and the horsemen and tracks have yet to receive any of the more than $80-million being held in escrow. After the casinos successfully challenged the legislation in court, the Illinois Supreme Court overturned the decision by a 7-0 vote.

The casinos then appealed to the U.S. Supreme Court. The high court is not expected to consider the case until summer of 2009.
