Arlington Park agrees to settlement in Federal housing lawsuit

Arlington Park has agreed to a settlement in a Federal lawsuit brought by the United States and HOPE Fair Housing Center regarding the suburban Chicago track’s backstretch housing.

The settlement still must be approved by the federal court. It states that Arlington may limit residence in buildings located next to stables and related operations to licensed backstretch workers.

The settlement also states that not placing children in certain residential buildings because of safety concerns does not constitute discrimination under the federal Fair Housing Act.

Arlington also will pay a $10,000 civil penalty and will donate $100,000 to District 214 Community Education as part of the settlement. The money will be used to expand “Kids on Track,” an eight-week summer program that will be conducted on weekends for the next three years. Any remaining funds will be used to purchase new recreational and/or computer equipment.

“The terms of this settlement validate our concerns and policy,” Arlington Park President Roy Arnold said. “The safety of children living on the backstretch has always been our primary concern.”

Arlington spent $4.2-million to construct two new buildings with 96 total housing units prior to the start of the track’s 2005 racing season. Forty-eight new family units that are being constructed as part of a $2.6-million residential building are scheduled to be completed when Arlington opens its live racing meet on May 4.

HOPE Fair Housing filed a complaint with the United States Department of Housing and Urban Development against Arlington in June 2004, alleging that backstretch workers at the track were being discriminated against because of family status, race, and national origin in violation of the Fair Housing Act.
