O’Brien, O’Donoghue face inquiry

Ballydoyle trainer Aidan O’Brien and jockey Colm O’Donoghue will be called before the disciplinary panel of the British Horseracing Authority to discuss allegations of a possible breach of the team tactics rule during the Juddmonte International Stakes (Eng-G1) on August 23 at Newmarket.

Duke of Marmalade won the 1 1/4-mile race under Johnny Murtagh.

O’Donoghue rode pacesetter Red Rock Canyon. The British Horseracing Authority will examine whether O’Donoghue moved his mount off the rail to allow stablemate Duke of Marmalade a clear path.

"We have completed the review process and written to Aidan O'Brien and Colm O'Donoghue confirming that they will need to appear before the disciplinary panel in connection with a possible breach of Rule 153(iv) in the Juddmonte International,” BHA media relations manager Paul Struthers said in a statement.

"We are obviously conscious of the interest this will generate but, having reviewed the video and read comments attributed to Johnny Murtagh in the press, it was felt that a formal inquiry into the incident had to be held. This will ensure that the matter is considered thoroughly, fairly and openly.”

The rule prohibits the jockey of one horse from making a maneuver in the interest of assisting another horse from the same stable.

"This is the first time we have reviewed a race for a possible breach of team tactics since the rules changed in 2007 and we are satisfied that there has been no other race where an inquiry should have been held,” Struthers said. “I would also like to make clear that there is no possibility of the result of the Juddmonte International being affected."

The inquiry is slated to take place the week of September 22.

According to the British Horseracing Authority’s release, the penalty for a jockey found guilty of breaching the rule is a ban of five to ten days with a trainer in violation subject to a fine.
